Terms of service
These Terms of Service (“Terms”) apply to your use of the Avery & Hale website and every purchase made on it. They are a binding agreement between you and Pawja Ltd (“we”, “us”, “our”). By using the website, placing an order or downloading a product, you accept these Terms. If you do not agree, please do not use the website.
1. Who we are
Avery & Hale is the trading name of Pawja Ltd, a private limited company registered in England & Wales under company number 17218329, with its registered office at Office 19097, 182-184 High Street North, East Ham, London, E6 2JA, United Kingdom.
2. Eligibility
You must be at least 18, or use the website under the supervision of a parent or guardian, and have legal capacity to enter into a contract. We may refuse service to anyone who does not meet these conditions.
3. Products
We sell digital fitness and wellness eBooks delivered only in electronic form; no physical items are shipped. We work to keep descriptions, images and prices accurate, but cannot guarantee they are free of errors and may correct them at any time without notice.
4. Health disclaimer
Our content is for general educational purposes and is not medical advice, diagnosis or treatment. Consult a doctor or qualified professional before starting any exercise or nutrition programme, especially if you have a health condition, are pregnant or are new to exercise. You take part in any activity described in our eBooks at your own risk, and should stop and seek medical help if you feel pain, dizziness or discomfort. Results vary and are not guaranteed.
5. Prices
Prices appear in the checkout currency and include applicable taxes unless stated otherwise. We may change prices at any time, but changes never affect orders already paid. Discount codes are subject to their own terms and expiry dates.
6. Orders and payment
By placing an order, you confirm your billing and payment details are correct and that you are authorised to use the payment method. Payments are processed securely by third-party providers; we do not keep full card details. We may refuse or cancel orders in cases of suspected fraud, pricing errors or breach of these Terms, and will fully refund any cancelled paid order.
7. Delivery
After payment, your eBook(s) are provided by download link and/or email, as set out in our Shipping Policy. You are responsible for providing a valid email address and suitable equipment to open the files.
8. Licence and intellectual property
All eBooks and website content are owned by Pawja Ltd or its licensors and protected by copyright and intellectual property law. Each purchase gives you a personal, non-exclusive, non-transferable and revocable licence to download and use the eBook for your own non-commercial purposes. You may not copy, share, resell, sublicense, publish, adapt or create derivative works from any content, in whole or in part, without our written consent. Infringement may lead to legal action.
9. Acceptable use
You must not use the website unlawfully, attempt unauthorised access to our systems or data, disrupt the website, upload malicious code, or use bots or scrapers to extract content.
10. Refunds and withdrawal
Refunds are governed by our Refund Policy, which is part of these Terms. By requesting immediate access to digital content, you accept that your right of withdrawal ends once delivery has started.
11. Third-party services
The website may use or link to third-party services such as payment providers. We are not responsible for their content, terms or practices.
12. Disclaimer of warranties
The website and products are provided “as is” and “as available”. To the extent permitted by law, we exclude all implied warranties and do not guarantee uninterrupted or error-free operation.
13. Limitation of liability
To the extent permitted by law, Pawja Ltd, its directors and staff are not liable for indirect or consequential loss, including loss of profit, data or goodwill, or for any injury resulting from activities undertaken without appropriate professional guidance. Our total liability for any claim is limited to the price you paid for the product concerned. Nothing in these Terms excludes liability that cannot be excluded by law or affects your mandatory consumer rights.
14. Indemnity
You agree to compensate Pawja Ltd for any claims, losses or costs, including reasonable legal fees, arising from your breach of these Terms or misuse of the website or products.
15. Events beyond our control
We are not liable for delays or failures caused by events beyond our reasonable control, including hosting outages, payment system failures or natural disasters.
16. Changes to these Terms
We may update these Terms at any time. Changes take effect once posted on this page, and continued use of the website means you accept them.
17. Severability
If any provision is found invalid or unenforceable, the remaining provisions remain in force.
18. Entire agreement
These Terms, together with our Privacy Policy, Refund Policy and Shipping Policy, form the entire agreement between you and Pawja Ltd.
19. Governing law
These Terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction over any dispute. Consumers living in other countries retain the protection of the mandatory laws of their country of residence.
